Get to know Eugene

Eugene Scott-Amy joined Ferraiuoli in 2018 as Counsel in the Corporate, Environmental and Land Use Law Practice groups. His practice covers a broad range of matters in the areas of Environmental, Natural Resources, Energy, and Land Use law, with particular emphasis in real estate and commercial transactions, regulatory compliance and environmental litigation.

Throughout his career Eugene has represented clients involved in oil and gas operations, large scale renewable energy projects, hotel and mixed-use developments, siting of telecommunication facilities, waste management and pharmaceutical operations.  He also served as Legal Advisor and Vice President of the Puerto Rico Environmental Quality Board (EQB).

Eugene has represented clients in enforcement actions before the U.S. Environmental Protection Agency (EPA), the Puerto Rico Energy Bureau (PREB), the Department of Natural and Environmental Resources (DNER), the U.S. Army Corps of Engineers (USCOE), the Permits Management Office (OGPe, by its Spanish acronym), the Puerto Rico Planning Board (PRPB), the Occupational, Health & Safety Office of the Puerto Rico Department of Labor and Human Resources, the Bureau of Transportation and other Public Services, and the Puerto Rico Aqueduct and Sewer Authority (PRASA).

After graduating from the InterAmerican University School of Law in 1999 and obtaining an LL.M. in Energy and Environmental Law from Tulane University in 2001, Eugene served as Legal Advisor to the Governing Board of the EQB from 2001 to 2003. During that time, he was responsible for drafting Agency resolutions and case rulings relating to adjudicative proceedings, establishing policy statements and representing the Agency before the P.R. Court of First Instance and the P.R. Court of Appeals.  He was also responsible for coordinating amendment proceedings for Puerto Rico regulations dealing with solid waste, air pollution, water quality and environmental impact statements.

What is your primary focus?

My focus is to provide practical legal advice that is both legally sound and driven by the client’s needs and objectives. Delivering accurate responses to our clients’ requests and helping them navigate through the numerous legal and regulatory requirements to meet their plans and project timelines are at the top of my priorities.

What do you find most rewarding?

Knowing that I advanced the needs and goals of my clients in a cost-effective and timely manner is truly rewarding because it reflects a result-driven approach to my work, which for me defines resourcefulness.

  • Acted as local counsel to a leading global energy company in the procurement process for the development of utility scale solar and energy storage projects.
  • Assisted a major hospital facility in the due diligence and negotiation of a power purchase and operating agreement (PPOA) involving a combined heat and power (CHP) project.
  • Represented a global medical device manufacturer before government agencies pertaining to environmental compliance and enforcement matters.
  • Represented various solid waste management, recycling and disposal corporations with regards to landfill operations and expansion projects, as well as in general compliance and enforcement matters.
  • Represented a multinational energy company in the development stages of a large-scale solar renewable energy project.
  • Represented a national telecommunications company in the acquisition of telecommunications towers and facilities in Puerto Rico.
  • Participated in the drafting of several environmental policy laws and regulations designed to create new permitting mechanisms for local governmental entities.
  • Represented a major local manufacturer of aggregates in land use litigation and related environmental matters.
  • Represented several national pharmaceutical companies with regards to federal regulatory compliance issues, as well as in disputes at the administrative and judicial level.
